Blue Ridge Weight & Wellness (BRW²) and Mollavita
Effective Date: September 1, 2026

1. Who We Are and What This Policy Covers

Blue Ridge Weight & Wellness (“BRW²”) is a physician-led, direct-pay medical weight management and wellness practice in Waynesville, North Carolina. Mollavita is our medical aesthetics business. Both are operated by Jon Michele, LLC. In this policy, “we,” “us,” and “our” mean Jon Michele, LLC, including BRW² and Mollavita.

This policy explains how we handle personal information collected through brw2.com, any other website we operate for BRW² or Mollavita, our online booking, our website forms, and the text messages, emails, and calls we use to communicate with you. It does not apply to other websites we link to.

2. Health Information and Our Patient Privacy Practices

Information we create or receive as your health care provider is also protected by HIPAA and other laws, to the extent they apply to us. Any Notice of Privacy Practices we give to patients describes how that information may be used and disclosed and explains your rights. If this policy and a Notice of Privacy Practices differ about your health information, the Notice of Privacy Practices controls.

3. Please Keep Medical Details Out of Forms, Email, and Text

  • Our website forms, standard email, and standard text messages are not designed for sensitive medical information. Please do not include diagnoses, medications, test results, or other clinical details. We collect clinical information through the secure systems we use for patient care or at your visit.
  • Please do not use our website or text messaging for emergencies. If you believe you are having a medical emergency, call 911.
  • Submitting an inquiry does not create a physician-patient relationship. It does not guarantee acceptance into the practice or that any treatment or medication will be prescribed.

4. Information We Collect

Information you give us

  • Contact details and messages: your name, email address, phone number, and the message you send through a form, email, text, or call.
  • Scheduling details: appointment date, time, and type, and your communication preferences.
  • Payment details: card and billing information you provide to pay us, which is handled by our payment processing service.
  • Intake and consent forms: information you enter on forms we send you for your care.
  • Messaging records: your phone number, when you opted in to or out of text messages, and the messages we exchange.
  • Photos, videos, or testimonials: only if you give us written permission.

Information collected automatically

When you visit our website, our hosting and website tools may log your IP address, browser and device type, the pages you view, the date and time of your visit, and the page that referred you.

5. How We Use Information

  • To respond to your questions and requests.
  • To schedule, confirm, and remind you of appointments, and to communicate with you about your care and account.
  • To process payments and keep business records.
  • To provide and document your care.
  • To send promotional messages to people who have opted in to receive them.
  • To protect the security of our website and systems, prevent fraud, and meet legal obligations.
  • To understand, in general terms, how our website is used so we can improve it.

We do not use the health information you provide through booking, intake forms, or messaging to advertise to you through third-party advertising platforms.

6. Online Booking, Payments, and Client Messaging (Boulevard)

We use Boulevard, a third-party software platform, for scheduling, payments, client forms, and client messaging, including two-way text messaging. When you book or message us through Boulevard, your information is handled by Boulevard on our behalf as a service provider. Where Boulevard handles protected health information for us, we have a business associate agreement with Boulevard covering the services that agreement designates.

Payments you make to us online or in person may be processed through Boulevard and its payment partners. Boulevard publishes its own documents about its booking tools, including a Client Privacy Notice and Client Terms of Service.

7. Text Messaging (SMS), Including Two-Way Messaging

Who sends texts. BRW² and Mollavita send text messages through Boulevard from the business phone number we give you. You can reply to our texts, and our staff may reply to you.

Types of messages. Service messages include appointment confirmations and reminders, scheduling changes, links to forms, payment or account notices, and replies to your questions. Promotional messages include offers, events, new services, and practice news. We send promotional messages only to people who have opted in to receive them. You do not have to receive promotional messages to receive care.

How you opt in. You may opt in when you book online, by providing your phone number and agreeing to receive texts on one of our forms, by texting our business number, or by completing a consent form at our office. When you book online, Boulevard’s booking screen explains how booking affects your text-message choices. Our staff cannot sign you up for promotional texts on your behalf.

How to stop or get help. Reply STOP or UNSUBSCRIBE to any text to stop all text messages from us. Reply NO PROMOS to stop promotional texts only. Reply START to the business number to begin receiving messages again, or manage your preferences in your client portal. Reply HELP or call (828) 550-6814 for help. After you opt out, we may send one message confirming your request.

Cost and frequency. Message frequency varies. Message and data rates may apply.

Your mobile information. We do not sell, rent, or share your mobile phone number or your text-message opt-in and consent information with third parties or affiliates for their marketing or promotional purposes. We share it only with service providers, such as Boulevard, that deliver our messages on our behalf, and where required by law.

Texts are not secure. Standard text messages are not encrypted. We keep medical details out of our texts, and we ask that you do not send us any.

8. Cookies and Website Technologies

Cookies and similar technologies are small files or code that help a website work and, in some cases, collect information about visits. Our website uses technologies needed to operate and secure the site, and may use basic analytics to understand, in general terms, how visitors use it. Embedded items such as maps, videos, fonts, or social media buttons may set their own cookies. Boulevard’s booking tools may use their own cookies or similar technologies.

We do not use the information you submit through booking, intake forms, or messaging for advertising. You can block or delete cookies in your browser settings, though parts of the site may not work as expected. If we add tracking tools that change this description, we will update this policy.

9. How We Share Information

  • Service providers that help us run the practice, such as Boulevard (scheduling, payments, messaging), Practice Fusion (electronic health records and prescribing), Spruce (clinical communication), FollowMyHealth (patient portal), SECA myAnalytics (body-composition reporting), and our website hosting and email providers. We may also use information that has been de-identified or combined so that it no longer identifies you.

10. Photos, Testimonials, and Social Media

We use patient photos, videos, or testimonials in our marketing only with the patient’s written permission. We do not confirm whether someone is our patient, and we do not respond to online reviews or social media comments in a way that reveals that. Please do not share health details in public posts or comments.

11. Security

We use reasonable administrative, technical, and physical safeguards intended to protect information we hold, and we choose service providers that agree to protect information. No website or electronic system can be guaranteed completely secure. If an incident affects your information, we will notify you and others as required by law.
